Constitutionality of IfSG compensation distinctions between preventive and control measures for business closures
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court’s decision and leaving the prior judgment in force. The dispute concerned a claim for compensation under the Infectious Diseases Protection Act (IfSG) regarding coronavirus-related business closures. The court held that the distinction between "disturbances" (Störungen) and "non-disturbances" (Nichtstörungen), as well as the legal differentiation between preventive and control measures, does not require federal intervention or indicate a fundamental legal contradiction. Specifically, the lack of compensation for non-disturbing businesses subject to area-wide closures during the control phase, in contrast to the entitlement to compensation for disturbances under § 56 Abs. 1 Satz 1 IfSG or non-disturbances under § 65 Abs. 1 Satz 1 IfSG (limited to the preventive phase), is a constitutionally permissible differentiation. Consequently, the plaintiff's challenge to the constitutionality of these statutory distinctions was rejected, and the plaintiff is ordered to bear the costs of the proceedings.
