The Federal Court of Criminal Justice dismissed the defendant's appeal as unfounded, with the sole exception of correcting a procedural oversight by setting the individual custodial sentence for count II.14 to the statutory minimum of three months; the defendant bears the costs of the proceedings. The case involved a challenge to a lower court’s judgment regarding drug trafficking, specifically the handling of cannabis offenses in concurrence with aiding and abetting. The decision rested on the doctrine of process economy and the prohibition of aggravation (Verschlechterungsverbot), applying § 354 (1) Code of Criminal Procedure to rectify the omitted individual sentence without violating the defendant's rights, while finding no other legal errors under § 349 (2) Code of Criminal Procedure and referencing § 34 (3) sentence 1 of the Cannabis Act for the minimum penalty threshold.

Volltext
