Imposition of a unified juvenile sentence in lieu of separate custodial terms under § 105 Abs. 1, § 31 Abs. 2 JGG
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's appeal as unfounded but modified the sentence to a single unified juvenile custodial penalty of five years and ten months, with the defendant bearing the costs of the appellate proceedings. The case involved a challenge to a juvenile criminal conviction where the lower court had imposed separate sentences, and the appellate court addressed the sentencing structure and the adequacy of the reasoning regarding educational considerations. The decisive legal basis was § 349 Abs. 2 StPO for the correction of the sentencing format and §§ 105 Abs. 1, 31 Abs. 2 Satz 1 JGG, which mandate the imposition of a unified juvenile sentence (Einheitsjugendstrafe) instead of individual consecutive terms, while confirming that the lower court sufficiently accounted for the educational purpose of the sentence under § 18 Abs. 2, § 105 Abs. 1 JGG.
