Inadmissibility of Anhörungsrüge for non-compliance with filing deadline and mere repetition of substantive legal errors
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Procedure dismissed the defendant’s complaint for hearing (Anhörungsrüge) as inadmissible and ordered the defendant to bear the costs, leaving the prior rejection of his appeal in force. The dispute concerned the defendant’s attempt to challenge the appellate senate’s dismissal of his appeal against a conviction by the Regional Court of Munich I; the defendant’s filing solely reiterated substantive legal objections without alleging that the court had disregarded relevant facts or failed to afford him a hearing. The court held the complaint inadmissible primarily because the defendant failed to comply with the one-week filing deadline under § 356a StPO, and alternatively found that the senate had fully addressed the arguments and upheld the defendant’s right to be heard under Article 103(1) of the Basic Law, rendering the mere repetition of substantive errors ineffective for this procedural remedy.
