The defendant’s motion for hearing (Anhörungsrüge) was dismissed as inadmissible, leaving the challenged appellate decision in force. The case involved a procedural challenge to a decision rendered in a Rechtsbeschwerde (post-appeal) proceeding, where the defendant argued that their right to be heard had been violated. The Federal Court of Justice held the motion inadmissible because the defendant failed to comply with the mandatory requirement of representation by a lawyer admitted to practice before the Federal Court of Justice, as stipulated by § 78 Abs. 1 Satz 3 ZPO. The court noted that independent of this procedural defect, the claim under Article 103 Abs. 1 GG was not substantively established.
