Aiding and abetting preparation of serious state-endangering violent act: liability for accomplices under § 89a StGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Third Criminal Senate dismissed the appeals of multiple defendants against a Frankfurt am Main Regional Court judgment, upholding the lower court’s conviction order and imposing the costs of the appeal on each appellant. The case involved charges related to the preparation of serious crimes endangering the state, specifically addressing whether the defendants were convicted as principal perpetrators or as accomplices under § 89a StGB. While the Senate clarified in its supplementary remarks that the perpetrator of preparatory acts need not be identical to the perpetrator of the serious crime, it determined that the defendants were not adversely affected by being convicted for aiding and abetting the preparation of a serious state-endangering violent act rather than as joint principals, rendering the convictions legally correct.
