Robbery conviction; sufficiency of testimony recording under § 261 StPO and recognition of failed robbery upon finding no loot
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 2nd Criminal Senate rejected the defendant's appeal, leaving the Limburg Regional Court's conviction from April 26, 2024, in force and ordering the defendant to bear the costs of the proceedings. The dispute centered on a robbery conviction, where the defendant challenged the judgment on the grounds that the appellate court failed to adequately record the co-defendant's testimony, alleging that the recorded statement did not cover all established facts of the joint planning, execution, and flight. The court found no legal error to the defendant's disadvantage, rejecting the claim under Section 261 of the Code of Criminal Procedure (StPO) as the co-defendant's statement was not contradictory or lacking, and noting that the conviction did not depend on whether the defendant heard the victim's statement regarding lack of cash, but rather on the fact that the defendant, acting according to the plan, searched for loot and recognized the failure of the robbery when nothing was found.
