Consumer loan: Extinction of withdrawal right upon full performance of credit contract
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) rejected the plaintiff's complaint against the non-admission of revision, leaving the lower court’s decision in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a consumer credit agreement where the plaintiff attempted to exercise a right of withdrawal years after the loan had been fully satisfied. The court held that the right of withdrawal under Article 14(1) of Directive 2008/48/EC ceases to exist upon full performance of the loan contract, a principle confirmed by recent European Court of Justice jurisprudence; consequently, the plaintiff's claim lacked legal merit, and the court declined to provide a further detailed justification pursuant to Section 544(6) of the Code of Civil Procedure.
