Inadmissibility of Rechtsbeschwerde and lack of legal representation under §§ 574, 78 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's filings as inadmissible, ordering the plaintiff to bear the costs, thereby upholding the lower court's refusal to hear the case. The dispute involved a procedural attempt to file a "Rechtsbeschwerde" and a "Nichtzulassungsbeschwerde" against an order from the Higher Regional Court, which the court rejected because statutory law does not expressly provide for these remedies in this specific procedural context and the lower court did not admit them. The decisive legal basis for the dismissal included § 574(1) of the Code of Civil Procedure (ZPO), which governs the admissibility of the appeal, and § 78(1) sentence 3 ZPO, which invalidated the filings due to the absence of representation by a lawyer admitted to the Federal Court of Justice.
