Denial of standby counsel and legal aid for complaint against non-admission of revision due to lack of prospects and failure to demonstrate effective search for alternative representation
Legislator-Zusammenfassung
KI-generiertThe BGH 9th Civil Senate dismissed the plaintiff's application for the assignment of a standby counsel and legal aid, denying the relief sought in her proceeding against the non-admission of revision by the Düsseldorf Higher Regional Court. The dispute arose in a civil litigation context where the plaintiff, having initiated a complaint against the lower court’s refusal to allow an appeal to the BGH, faced a refusal from her retained attorney to brief the complaint due to lack of prospects of success, prompting her to seek substitute representation and cost assistance. The court held that the assignment of a standby counsel was unwarranted because the plaintiff failed to demonstrate that she had exhausted reasonable efforts to secure alternative representation within the briefing deadline and because the intended legal recourse was deemed hopeless; specifically, the case lacked fundamental legal significance or a need for the development of law under Section 543(2) of the Code of Civil Procedure. Additionally, the request for legal aid was rejected due to the plaintiff’s failure to submit the mandatory statutory financial declaration and supporting documents within the prescribed period, and because the underlying action lacked a sufficient prospect of success under Section 114(1) of the Code of Civil Procedure.

Oktober 2023 - IX ZA 15/23, juris Rn. 1 mwN). Im Übrigen bietet die beabsichtigte Rechtsverfolgung keine hinreichende Aussicht auf Erfolg (§ 114 Abs. 1 Satz 1 ZPO).
