Lawyer disciplinary appeal: Failure to substantiate fundamental legal question for non-admission of revision under § 145 Abs. 3 BRAO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Senate for Legal Professional Matters rejected a lawyer's complaint against the non-admission of an appeal in revision, leaving the judgment of the Anwaltsgerichtshof Sachsen-Anhalt from June 20, 2025, in force; the complainant was ordered to bear the costs of the legal remedy. The dispute concerned a disciplinary proceeding where the lawyer challenged the lower court’s refusal to allow a revision, having previously irrevocably restricted his appeal to the judgment on legal consequences, and arguing a violation of his right to be heard. The BGH deemed the complaint inadmissible because the lawyer failed to specify a fundamental legal question or a question of professional duties as required by § 145 Abs. 3 Satz 3 BRAO, which must be abstractly formulable, significant beyond the individual case, and not immediately derivable from law, self-evident, or already settled by higher courts. The cost order was based on § 116 Abs. 1 Satz 2 BRAO and § 473 Abs. 1 Satz 1 StPO.

Dezember 1961 - AnwSt (B) 6/61, BGHSt 17, 21, 27 f. und vom 20. März 2007 - AnwSt (B) 6/06, NJW-RR 2007, 1506 Rn. 9; Weyland/Reelsen, BRAO, 11. Aufl., § 145 Rn. 9). Dem genügt das Vorbringen des Rechtsanwalts nicht, der zudem auch in Ansehung der Beschwerdebegründung eine unwiderrufliche und unanfechtbare Beschränkung der Berufung auf den Rechtsfolgenausspruch erklärt hat (vgl. allgemein BGH, Urteil vom 6. Dezember 1961 - 2 StR 485/60, BGHSt 17, 14, 18; Beschluss vom 10. Januar 2001 - 2 StR 500/00, BGHSt 46, 257, 258; KK-StPO/Paul, 9. Aufl., § 318 Rn. 2a, § 302 Rn. 13 mwN;
Schmitt/Köhler, StPO, 68. Aufl., § 302 Rn. 10, 22).
