Legislator-Zusammenfassung

The Federal Court of Justice (BGH) rejected the plaintiff's hearing complaint as inadmissible, leaving the underlying appellate decision of January 14, 2026, in force; the plaintiff bears the costs. The dispute concerned a procedural objection to a prior decision in a legal appeal (Rechtsbeschwerde) process, where the plaintiff argued that the court had violated their right to be heard by rejecting their personally filed appeal. The decisive legal basis for the rejection was the mandatory representation rule under § 78 Abs. 1 Satz 3 ZPO, which requires that a hearing complaint in a legal appeal proceeding must be filed by a lawyer admitted to the BGH, thereby rendering the plaintiff's unrepresented filing inadmissible; the court additionally found that the complaint was unmerited as the prior decision provided sufficient legal reasoning and no hearing violation was demonstrable.

Januar 2026 - I ZB 94/25 Rn. 1; Beschluss vom 21. Juli 2021 - I ZB 28/21 Rn. 2 m.w.N.).

Januar 2026 - I ZB 94/25 Rn. 2).
