Consumer credit withdrawal after full performance of the loan contract
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s non-acceptance complaint, thereby upholding the lower court’s decision and leaving the challenge unsuccessful. The case involved a consumer loan agreement where the plaintiff attempted to exercise a right of withdrawal after the loan had been fully repaid. The court determined that under the established case law of the European Court of Justice, no right of withdrawal under Article 14(1) of Directive 2008/48/EC (Consumer Credit Directive) exists once a consumer loan contract is fully performed. Consequently, the plaintiff’s attempt to withdraw from the completed contract was legally invalid, and the costs of the appeal were assigned to the plaintiff.
