Legislator-Zusammenfassung

The Federal Court of Civil Procedure dismissed the debtor's hearing complaint (Anhörungsrüge) as inadmissible and unfounded, leaving the prior appellate decision in force and ordering the debtor to bear the costs. The case involved a debtor's challenge to an insolvency proceeding decision, where the debtor alleged a violation of the right to be heard. The court held that the complaint was filed outside the statutory two-week grace period following service of the original ruling and substantively failed because the debtor's intended legal action lacked reasonable prospects of success. The ruling rests on §§ 321a, 97 Abs. 1 ZPO, establishing that the objection was time-barred and that no material breach of due process occurred given the futility of the underlying claim.

[GRUENDE]

I. Die Anhörungsrüge ist unzulässig und unbegründet.
