Legislator-Zusammenfassung

The Federal Court of Justice rejected the plaintiff’s objection, upholding the court fees assessed for the non-admission complaint procedure. The dispute concerned a procedural fee challenge (costs objection under § 66 GKG) arising from the dismissal of a complaint against the non-admission of a legal revision. The court held that the objection was unfounded because dissatisfaction with the substantive decision on non-admission does not constitute a procedural error under § 21 GKG, as the fee review does not permit re-examination of the merits or the prior dismissal order; the decision is final and free of court fees, with no reimbursement of extrajudicial costs.

BGH, Beschluss vom 3. Februar 2021 - IX ZR 93/20, ZfS 2021, 525 Rn. 7) noch eine erneute Überprüfung der Sachentscheidung der Vorinstanz statt.

3. Die Entscheidung ergeht gerichtsgebührenfrei. Außergerichtliche Kosten werden nicht erstattet (§ 66 Abs. 8 GKG).
