Consumer credit withdrawal right extinguished by full loan performance under Directive 2008/48/EC
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff’s non-admission complaint, upholding the Lower Court’s decision and ruling that the plaintiff bears the procedural costs. The dispute concerned a consumer credit agreement where the borrower attempted to exercise a right of withdrawal after the loan contract had already been fully performed. The decisive legal basis is the interpretation of Article 14(1) of Directive 2008/48/EC (Consumer Credit Directive), as clarified by the Court of Justice of the European Union, which holds that no right of withdrawal arises for the borrower once the loan contract is fully fulfilled; consequently, the legal matter lacked fundamental significance and did not require further development of law by the revision court.
