Invalid transfer of juvenile criminal proceedings under § 42(3) JGG without post-indictment change of residence
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Revision overturned the decision transferring the criminal proceedings from the local district court (Juvenile Division) of Rostock to the district court (Juvenile Division) of Leverkusen, thereby restoring jurisdiction to the original court for investigation and adjudication. The dispute concerned a juvenile criminal case where the initial court attempted to transfer jurisdiction under § 42(3) JGG on the premise that the defendant had changed her residence after the indictment was filed; however, the facts did not support this prerequisite. The decisive legal basis was § 42(3) JGG, which the higher court interpreted to strictly require a post-indictment change of residence for such a transfer, ruling that an alternative transfer under § 12(2) StPO was also precluded due to the defendant’s currently unknown whereabouts.
