Information on extrajudicial complaint and redress procedures in consumer credit agreements
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) unanimously dismissed the plaintiff's revision, leaving the lower court's judgment in force and imposing the costs of the appellate proceedings on the plaintiff. The dispute concerned a consumer credit claim where the plaintiff challenged the adequacy of the defendant bank's information regarding access to extrajudicial complaint and redress procedures. The court determined that the revision lacked a prospect of success and that the case had no fundamental legal significance, as the required disclosures had been properly provided in accordance with the BGH's precedent established in its June 4, 2024, judgment (XI ZR 113/21), which aligns with the case law of the Court of Justice of the European Union.

[GRUENDE]
Juni 2024 (XI ZR 113/21, WM 2024, 1207 Rn. 36 ff.) ordnungsgemäß erteilt.
