Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's appeal as inadmissible, ruling in favor of the procedural integrity of the higher court and ordering the dismissal at the defendant's expense. The dispute concerned a procedural challenge via a motion to correct (Anhörungsrüge) against a prior BGH order, where the defendant alleged a violation of the right to be heard. The court determined the motion was procedurally defective for failing to specifically demonstrate that the prior decision was affected by a material denial of hearing, and added that on the merits, the defendant’s arguments had already been reviewed and found unsubstantiated. The decision rests on § 544 Abs. 6 Satz 2 Halbs. 2 ZPO in conjunction with § 321a Abs. 4 Satz 5 ZPO, which permits omitting a detailed justification when the complaint is evidently unmerited.

Volltext
