The Federal Court of Justice dismissed the plaintiff’s complaint against the refusal to admit an appeal in revision, thereby upholding the Stuttgart Higher Regional Court’s judgment and leaving the defendant’s successful termination of the contract and denial of the compensation claim in force. The dispute centered on a commercial agent’s claim for compensation, challenging a contract termination that resulted from the agent’s allegation that a required vaccination certificate had been forged. The court held that no obligation existed to refer the question to the Court of Justice of the European Union under Article 267 TFEU regarding Articles 17 and 18(a) of Council Directive 86/653/EEC because the issue was not decisive; the termination and the refusal to pay compensation were both immediate consequences of the same culpable behavior by the agent, thereby satisfying the conditions for a valid termination.
