Scope of unfair terms directive application to business-used consumer bank accounts
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s appeal against non-admission of revision, leaving the Oberlandesgericht Oldenburg’s decision in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned the applicability of EU Directive 93/13/EEC on unfair terms in consumer contracts to a checking account held by the plaintiff, who argued that the lower courts had failed to refer questions to the Court of Justice of the European Union under Article 267(3) TFEU. The court held that the legal matter lacked fundamental significance and that the prior appellate court’s binding factual finding that the account was used for business purposes excluded the plaintiff from the definition of a "consumer" under Articles 1(1) and 2(b) of the Directive, rendering the Directive inapplicable and the request for a preliminary ruling moot.
