Attribution of simultaneous storage of narcotics to principal for legal concurrence in drug trafficking
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (3rd Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the Landgericht Koblenz's conviction for armed drug trafficking in concurrence with cannabis trafficking, while declining to amend the legal classification of specific acts as requested by the General Federal Prosecutor due to lack of complaint by the defendant. The dispute centered on whether the defendant committed an additional offense of trafficking narcotics in non-small quantities (regarding cocaine) in legal concurrence or in substantive concurrence with the original charges. The Court held that while a concurrent offense might seem plausible given the shared intent to sell, the factual basis for legal concurrence (Tateinheit) relied on the simultaneous storage of ecstasy tablets and cocaine in a single container, which was factually attributable only to the defendant's "bunker" helper and not to the defendant himself; therefore, the sentencing calculation was not materially affected for the appellant, and the original judgment stands.

Volltext
September 2023 - 3 StR 76/23, juris Rn. 8; vom 22. August 2019 - 1 StR 267/19, NStZ 2020, 403 Rn. 9; vom 20. September 2016 - 3 StR 302/16, wistra 2017, 231 Rn. 6; Patzak/Fabricius, BtMG, 11. Aufl., § 29 BtMG Rn. 522 ff.).
