Exclusion of mortgage-secured real estate loans from EU Consumer Credit Directive scope
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s complaint against the lower court’s refusal to grant leave for appeal, upholding the prior judgment and leaving the plaintiff to bear the costs of the proceedings. The dispute centered on whether a specific EU directive on consumer credit agreements applied to a 1.65 million euro real estate loan secured by a mortgage, a challenge raised by the borrower against the lender. The court held that the matter lacked fundamental legal significance and did not require further legal development or uniformity, as existing case law confirms that such mortgage-secured immovable property loans are excluded from the scope of the EU Consumer Credit Directive under specific statutory exceptions.
