Dem Beistand des Nebenklägers G. , N. , steht für das Revisionsverfahren 5 StR 326/23 anstelle der gesetzlichen Gebühren (Nr. 4130 und 4132 VV RVG) eine Pauschvergütung in Höhe von 2.137 Euro zuzüglich Auslagenpauschale und Abwesenheitsgelder sowie Umsatzsteuer zu.

Der durch Verfügung der Vorsitzenden vom 27. Juni 2024 bestellte Beistand des Nebenklägers G. hat wegen des besonderen Umfangs und der besonderen Schwierigkeit seiner Tätigkeit im Revisionsverfahren 5 StR 326/23 beantragt, eine Pauschgebühr von insgesamt 2.477 Euro einschließlich Auslagenpauschale und Abwesenheitsgeldern festzustellen. Die Vertreterin der Staatskasse hält die gesetzlichen Gebühren nach Nr. 4130 und 4132 VV RVG in Höhe von maximal 1.141 Euro im vorliegenden Fall nicht für zumutbar; sie hält die beantragte Pauschgebühr von 2.137 Euro zuzüglich der geltend gemachten Auslagenpauschale und Abwesenheitsgelder, mithin einen Betrag von insgesamt 2.477 Euro zuzüglich Umsatzsteuer für angemessen.

Sind die für das Revisionsverfahren gesetzlich vorgesehenen Gebühren eines gerichtlich bestellten Anwalts – wie hier – wegen des besonderen Umfangs und der besonderen Schwierigkeit nicht zumutbar, hat dieser gemäß § 51 Abs. 1 Satz 1 RVG einen Anspruch auf Feststellung einer an die Stelle der gesetzlichen Gebühren (hier gemäß Nr. 4130 und 4132 VV RVG) tretenden Pauschgebühr. Die Feststellung der Höhe der Pauschgebühr steht im pflichtgemäßen Ermessen des Gerichts. Unter Berücksichtigung des Umfangs und der Schwierigkeit der Tätigkeit des Antragstellers im Revisionsverfahren hält der Senat in Übereinstimmung mit der Vertreterin der Staatskasse eine Pauschgebühr von 2.137 Euro (Verfahrensgebühr nach Nr. 4130 VV RVG in Höhe von 1.221 Euro, Terminsgebühr nach Nr. 4132 VV RVG für zwei Termine in Höhe von insgesamt 916 Euro) für angemessen.
