Hearings objection: mandatory legal representation and two-week deadline for admissibility of Anhörungsrüge before the Federal Court of Justice
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) rejected a filing by the plaintiff, characterizing it as an impermissible "Hearings Rüge" (objection to lack of hearing) filed against the Senate's decision of 2 July 2024, and explicitly noted that the filing would not be forwarded to the Federal Constitutional Court as it exceeded the one-month constitutional complaint deadline. The dispute concerned a civil law matter where the plaintiff, acting without a lawyer admitted to the BGH, challenged the Senate's prior ruling on the grounds that her right to be heard was violated; however, the court found the objection procedurally defective due to the absence of mandatory legal representation, failure to meet the two-week statutory deadline, and insufficient factual argumentation. The decisive legal basis was § 321a ZPO, which governs the admissibility and requirements for hearing objections, specifically §§ 321a Abs. 1 and 2, alongside § 78 Abs. 1 Satz 3 ZPO regarding the mandatory requirement for authorized counsel before the BGH, and § 93 Abs. 1 BVerfGG regarding the one-month limitation period for constitutional complaints.
