The Federal Court of Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and ordering the defendant to bear the costs of the legal remedy. The case concerned a criminal appeal challenging a conviction for armed dealing with cannabis, specifically regarding whether the concurrent possession of a knife in the defendant's backpack constituted "armed" conduct. The court determined that the conviction was supported by the facts, finding that the defendant, who had admitted to the offense, possessed a knife suitable and intended for inflicting personal injury and carried it with at least conditional intent (dolus eventualis), thereby satisfying the statutory requirements for the aggravated offense of armed drug dealing.

Volltext
