Legislator-Zusammenfassung

The Federal Court of Criminal Justice dismissed the defendant's appeal as unfounded, leaving the guilty verdict of the Ulm Regional Court in force and ordering the defendant to bear the costs of the proceedings and the necessary expenses of the auxiliary plaintiff. The dispute concerned the procedural handling of defense motions for evidence, where the trial court had rejected the proposed witnesses under the assumption that the facts they were to prove were true, alleging violations of the continuity principle, the duty to clarify the case, and fair trial standards. The court held that the appeal failed because the trial court did not contradict its earlier rulings in the final judgment, as it reasonably refrained from engaging in a detailed analysis of the assumed true facts given the other established findings of fact. The decisive legal basis included §§ 244(2), 244(3) sentence 3 No. 6, and 244(6) sentence 1 of the Code of Criminal Procedure, as well as § 349(2) of the Code of Criminal Procedure.
