Criminal appeal: insufficiency of evidentiary specificity in supplementary witness requests and weighing of indicia for corporate fraud intent
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the appeals of the defendants as unfounded against the judgment of the Regional Court of Mannheim dated March 28, 2024, leaving the lower court's conviction in force and ordering each appellant to bear the costs of their respective appeals. The dispute concerned criminal proceedings in which the defendant's procedural objections were raised based on a supplementary evidence request, challenging the factual basis for establishing intent regarding the alleged hollowing out of a company structure, which the defendant characterized as a valid business strategy. The court rejected the procedural grounds, determining that the evidence request lacked sufficient specificity regarding time and place, and that the claimed exculpatory testimony was negligible in weight given the extensive corroborating indicia of guilt, such as close familial and business ties, prior searches, and the lack of liquidity in newly established entities. The decision relies on Section 349 Paragraph 2 of the Code of Criminal Procedure (StPO) and established doctrine that procedural objections fail if the requested proof of auxiliary facts is not specifically defined or is deemed insignificant against the totality of the conviction.
