Infection Protection Act compensation: substantive differentiation between "storers" and "non-storers" in comprehensive business closures
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's decision and leaving the defendant's position intact; the plaintiff bore the costs of the proceedings, with a disputed value of approximately €2.0 million. The dispute concerned whether "non-storers" affected by comprehensive pandemic-related business closures (under the German Infection Protection Act, IfSG) are entitled to compensation equal to that received by "storers" (those specifically restricted by order) or those in the prevention phase. The court held that the plaintiff's claim failed because existing jurisprudence justifies a substantive legal distinction between infection-protective "storers" and "non-storers," as well as a differentiation between compensation regimes for prevention measures versus combat measures; specifically, § 65 Abs. 1 Satz 1 IfSG provides compensation for non-storers only during the prevention phase, not for general combative closures.
