The Federal Court of Justice (BGH) dismissed the defendant’s appeal, upholding the regional court’s conviction and sentencing order. The dispute concerned the correct legal qualification of an incident where the defendant, armed with a knife, attempted to force a victim to return home and grant access to the apartment corridor without causing physical injury. The core legal issue was whether the offense of threat (§ 241 para. 2 German Criminal Code) should be subsumed under attempted coercion (§ 240 paras. 1, 3; §§ 22, 23 German Criminal Code) via statutory competition or punished in concurrence with attempted coercion. The court held that the lower court correctly applied the law by classifying the acts as threat in concurrence with attempted coercion, explicitly departing from its earlier 2022 view that statutory competition applied and instead aligning with recent jurisprudence post-dating the April 2021 amendment to the relevant statutes.

Gesetzeskonkurrenz bei Bedrohung und versuchter Nötigung

[TENOR]

April 2024 – 1 StR 152/24, juris; vom 10. April 2025 – 4 StR 495/24, juris Rn. 26; vom 12. November 2024 – 6 StR 572/24, juris Rn. 7; vom 13. Februar 2024 – 5 StR 443/23, BGHR StGB § 241 Abs. 2 Konkurrenzen 2 Rn. 6-8) nicht länger fest (vgl. ferner Fischer/Anstötz, StGB, 73.

Aufl., § 240 Rn. 64).
