Inadmissibility of Rechtsbeschwerde in enforcement proceedings without lower court admission under § 574 Abs. 1 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor’s appeal for review (Rechtsbeschwerde) as inadmissible, ruling that the debtor prevailed in no substantive respect and bore the costs of the proceedings; the lower court’s refusal to grant legal aid was also upheld. The dispute concerned a decision issued in a coercive enforcement procedure, where the debtor challenged the appellate court’s refusal to admit further appellate review. The decisive legal basis was § 577 Abs. 1 ZPO in conjunction with § 574 Abs. 1 Satz 1 Nr. 2 ZPO, establishing that appeals for review against enforcement decisions are only admissible if explicitly permitted by the lower appellate court; as no such permission was granted, the appeal was statutorily inadmissible, rendering the debtor’s request for a mandatory attorney under § 78b Abs. 1 ZPO unfounded due to the lack of prospects for success.

Die Rechtsbeschwerde des Schuldners gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 28.
BGH, Beschluss vom 2. Mai 2023 - I ZB 10/23, juris Rn. 2 mwN).
II.
