The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint regarding the non-admission of an appeal to the Supreme Court, thereby upholding the appellate court's refusal and leaving the lower instance judgment in force. The dispute concerned the guidelines compliance of an insurance policy model, where the plaintiff attempted to invoke the doctrine of good faith (Treu und Glauben) as a ground for judicial review. Relying on established case law, the court determined that the issue did not raise questions of fundamental legal significance, nor did it require the development of law or the assurance of uniform jurisprudence under § 543(2) sentence 1 ZPO; specifically, it found that the guidelines compliance issue was not decisive for the outcome and that a preliminary reference to the European Court of Justice regarding the good faith objection was unnecessary. Consequently, the plaintiff was ordered to bear the costs of the complaint proceedings.
