Sentencing aggregation: dissolution of prior total fine and inclusion of individual sentences under § 354 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Division (BGH 2. Strafsenat) dismissed the defendant's revision as unfounded but modified the judgment to correct the calculation of the total custodial sentence of four years and eight months, which now incorporates the individual fines from a prior 2020 penalty order. The dispute concerned the procedural method for merging a previous total fine into a new total custodial sentence, where the lower court had incorrectly ordered the inclusion of the "sentence from the conviction" rather than dissolving the existing total fine. Applying Section 354(1) of the Code of Criminal Procedure (StPO) by analogy, the appellate court itself performed the necessary dissolution of the prior total fine and the inclusion of its constituent individual fines, thereby correcting the sentencing aggregation without reopening the merits of the case.
