The Federal Court of Justice (BGH) ruled that the victim’s subsequent admission as a joint complainant (Nebenklägerin) in the criminal proceedings was effective, thereby finalizing her procedural status despite prior formal deficiencies. The dispute arose in a criminal appeal concerning a conviction for attempted murder committed in conjunction with the unlawful possession of a semi-automatic short firearm and ammunition, where the victim’s initial application to join the proceedings contained a formal defect under § 32d Sentence 2 StPO. The court determined that the re-submitted electronic declaration of intent, filed during the revision stage, validly satisfied the requirements for joinder, relying on the legal principles that such joinder is permissible at any stage of the proceedings (§ 395 Sentence 4 StPO) and is not contingent on the complainant retaining a right to appeal (§ 395 No. 2 StPO; BGH decision of 6 October 2025 – 2 StR 296/25).

Oktober 2025 – 2 StR 296/25, Rn. 3).
