Refusal to allow revision for non-admission: admissibility of preliminary EU reference on good faith and directive compliance in insurance dispute
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of an appeal, thereby upholding the lower court’s refusal to grant revision; consequently, the Oberlandesgericht’s decision remains in force. The dispute involved a challenge to a policy model, where the plaintiff sought to establish a violation of the EU Directive and principles of good faith (Treu und Glauben), along with constitutional claims under Articles 3(1) and 103(1) GG. The court held that the consistency of the policy model with the Directive was not dispositive in this case and that a preliminary reference to the Court of Justice of the European Union regarding the good faith argument was unnecessary, citing established Senate case law; it further found the constitutional violations unsubstantiated.
