Legislator-Zusammenfassung

KI-generiert

The BGH 6th Civil Senate dismissed the plaintiff's objection to the denial of a hearing, ordering that the lower court's decision remains in force and rejecting the plaintiff's challenge on their own costs. The dispute concerned a non-admission complaint where the plaintiff argued that the lower court failed to adequately address the classification of specific provisions of the European Community's Financial Regulation (EG-FGV) as protective statutes under German tort law, a matter potentially influenced by a European Court of Justice judgment. The decisive legal basis was Article 103(1) of the Basic Law guaranteeing the right to be heard, which the court found not violated because the plaintiff failed to sufficiently demonstrate the fundamental significance of the legal question and did not adequately engage with the interplay between EU law and national law as reasoned by the appellate court.
