Criminal sentencing record discrepancy and denial of auxiliary forensic handwriting evidence
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 5th Criminal Senate dismissed the appeals of the defendants as unfounded, upholding the judgment of the Hamburg Regional Court and ordering each appellant to bear their own legal costs. The case involved criminal proceedings where the defendants challenged the conviction through revisions, including a procedural objection to the rejection of an auxiliary evidence application for a forensic handwriting expert report. The court determined that the appeal failed because the procedural objection was moot, as the condition precedent for the application had not occurred according to the trial record, and the final sentence remained unchanged. Additionally, the court clarified that a discrepancy in the trial record citing a one-year sentence instead of the correctly imposed ten-month sentence for a specific count was an obvious clerical transcription error, leaving the operative ten-month sentence in force.
