Recusal motion for judges in federal disciplinary proceedings dismissed as manifestly inadmissible for lack of credible suspicion of bias
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court of the Federation (Dienstgericht des Bundes) dismissed the respondent's motion for recusal as inadmissible, resulting in a procedural victory for the court's composition and leaving the underlying disciplinary proceedings unaffected. The dispute involved a second motion filed by the respondent seeking the exclusion of the presiding judge and/or other panel members from the decision, which the court assessed under procedural rules governing judicial impartiality. The court held that the motion was manifestly inadmissible because the assertions provided were wholly unsuitable to establish any suspicion of bias under § 66 Abs. 1 Satz 1 DRiG, § 54 Abs. 1 VwGO, or § 45 Abs. 1 ZPO, thereby relieving the court of the requirement to obtain a formal statement from the judges and permitting the regular panel members to decide on the motion without exclusion.

Das Ablehnungsgesuch des Antragsgegners vom 2. Januar 2025 wird als unzulässig verworfen.
[GRUENDE]
Senatsbeschluss vom 23. September 2024 - RiZ(R) 2/24, juris m.w.N.).
