Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice’s 8th Civil Senate dismissed the applicant’s objection to the court’s cost assessment, upholding the imposition of 898 € in court fees. The dispute concerned a Rechtsbeschwerde (legal complaint) against an appellate court’s order dismissing the applicant’s Berufung (appeal) as inadmissible, where the appellate court had set the subject-matter value at 29,958.30 €. The court held that under No. 1820 of the Court Costs Act (GKG) schedule, a 2.0 fee multiple applies to proceedings against orders dismissing appeals as inadmissible, resulting in the calculated cost of 898 €. Furthermore, the court ruled that the cost notice was valid without a judge’s signature because it was generated automatically, and the applicant remained liable for the costs as the party responsible for the application and decision under §§ 22(1) sentence 1 and 29(1) GKG.

Die Erinnerung der Beschwerdeführerin vom 10. Juni 2024 gegen den Kostenansatz des Bundesgerichtshofs vom 29. Mai 2024 (Kassenzeichen 780024130569) wird zurückgewiesen.

[GRUENDE]

I. Mit Beschluss vom 14.

§ 25 Abs. 2 Satz 3 KostVfg; BGH, Beschluss vom 25. Mai 2022 - VIII ZB 65/21, juris Rn. 5).

3. Das Erinnerungsverfahren ist gerichtsgebührenfrei. Außergerichtliche Kosten werden nicht erstattet (§ 66 Abs. 8 GKG).
