Analogy in jurisdictional gaps and the prohibition of arbitrary judicial appointment under Article 101(1) Sentence 2 of the German Basic Law
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure dismissed the plaintiff's appeal in revision, leaving the Hanseatic Higher Regional Court's judgment in force and placing the costs on the plaintiff. The dispute concerned a procedural challenge to the application of jurisdictional rules, specifically whether a general prohibition against analogy applies to judicial jurisdiction regulations and how such gaps should be interpreted. The court held that no general prohibition of analogy exists for jurisdictional provisions and that legislative gaps in jurisdiction can be filled through established methods of judicial law-finding, rejecting the plaintiff's argument that this approach violated the constitutional guarantee of the judge determined by law under Article 101(1) Sentence 2 of the German Basic Law.
