Public hearing principle: Inadmissibility of objection lacking proof of trial chamber's fault despite non-public status indication
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) Fourth Criminal Senate dismissed the appeals of multiple defendants against the judgment of the Essen Regional Court of December 8, 2023, upholding the conviction and sentencing, while ordering all appealing defendants to bear their own costs and compensate the civil parties for necessary expenses incurred during the appellate phase; specifically, the court waived the imposition of litigation costs on one defendant based on their minor status under juvenile law. The case involved a criminal appeal where the defendants challenged the proceedings, including one defendant’s allegation that the trial violated the principle of public hearing by marking the session as non-public. The appellate court rejected the substantive merits for lack of procedural error and ruled the public hearing objection inadmissible under § 344 para. 2 sentence 2 StPO because the appellant failed to demonstrate that the trial chamber bore responsibility for the error, noting that the courtroom door was unlocked and spectators were present, which negated the claim of a diligent breach of duty.
