The Federal Court of Justice (3rd Criminal Senate) dismissed the defendant's revision as unfounded, thereby upholding the Landgericht Mainz’s conviction for aggravated bodily injury in concurrence with dangerous bodily injury and threat, resulting in a total custodial sentence of three and a half years, while simultaneously correcting the appellate judgment to expressly set the daily rate for the ancillary fine in the second case at 20 euros. The defendant, who had also been held liable in the civil adhesion proceedings, challenged the material law regarding the criminal sentencing, but the court found the substantive findings largely correct. The only legal defect identified was the first-instance court's failure to specify the daily rate for the fine imposed for the threat, despite the imposition of a total custodial sentence; the appellate court cured this procedural error by applying Section 354(1) of the Code of Criminal Procedure (StPO) by analogy to determine the daily rate based on the defendant's net income. Consequently, the prior lower-court judgment remains in force except for this supplementary determination, and the defendant was ordered to bear the costs of the revision and the necessary expenses of the auxiliary victim.

Volltext
