Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiff's hearing complaint as inadmissible and rejected the application for the assignment of a legal aid attorney, leaving the prior decision of the Senate dated November 11, 2024, in force. The dispute concerned a procedural challenge to a decision on legal appeal, where the plaintiff attempted to raise a hearing complaint without representation. The court ordered the complaint to be dismissed at the plaintiff's expense and denied legal aid because the intended legal action was deemed hopeless. The decisive legal basis was § 78(1) sentence 3 Code of Civil Procedure (ZPO), which imposes mandatory representation by a lawyer admitted to the BGH for hearing complaints against legal appeal decisions, rendering the unrepresented filing inadmissible; the denial of legal aid was further grounded in § 78b(1) ZPO due to the lack of prospects for success.
