Evidentiary weight of pre-offense medical report in challenging criminal capacity finding
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the defendant's appeal and his subsequent objection to the cost allocation as unfounded, thereby upholding the Hamburg Regional Court's original conviction and confirming that the defendant must bear the costs of his legal remedies. The dispute centered on a procedural complaint challenging the admission and consideration of a medical report from several weeks before the alleged crimes, which indicated the defendant was conscious and oriented, against the lower court's finding of full criminal capacity. The highest court ruled that the objection was meritless because the trial court's assessment of the defendant's mental state was based on a comprehensive variety of established activities, rendering the specific medical note subordinate in the overall factual picture; consequently, the court excluded that the judgment could have relied on a violation of the principles regarding the free evaluation of evidence under Section 256 of the Code of Criminal Procedure.

Volltext
