Subsidiary application of extended confiscation of criminal proceeds in drug trafficking cases
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) partially overturned the Berlin Regional Court’s confiscation order in a drug trafficking case, ruling that the defendant’s revision succeeded in part regarding the forfeiture of approximately €3,815 in foreign currency and a €32,880 repayment claim, while the remainder of the conviction and appeal were dismissed. The case involved a challenge to the confiscation of proceeds from band-like drug trafficking in non-quantities, specifically whether the funds should be seized under the extended confiscation provision (§ 73a StGB) or specific criminal act provisions. The appellate court held that the lower court erred by failing to verify whether the funds could be attributed to specific, individually identified criminal acts outside the charged factual complex; it clarified that confiscation under §§ 73 and 73c StGB takes precedence over extended confiscation under § 73a StGB, necessitating a factual assessment of attribution that the trial court omitted. Consequently, the matter was remanded to a different panel of the Regional Court for renewed proceedings on the specific confiscation issue, with the underlying factual findings upheld to the extent they were not affected by the legal error.

Betäubungsmitteldelikt: Subsidiarität der erweiterten Einziehung von Taterträgen
[TENOR]
