Allocation of criminal procedure costs and ancillary plaintiff expenses in dismissed revision appeals
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) Second Criminal Senate dismissed the defendant's appeal against the Landgericht Köln’s judgment of April 16, 2024, and simultaneously rejected his immediate complaint against the lower court’s cost order, leaving the original conviction and cost allocation in force. The defendant, who had been convicted of attempted manslaughter in concurrence with dangerous bodily harm, challenged the costs decision imposed by the trial court, which allocated general case costs to the defendant while assigning specific state prosecution expenses related to the dual charges to the state treasury and waiving the imputation of the civil plaintiff's necessary expenses. The BGH upheld the lower court’s determination, reasoning that the allocation of costs follows §§ 473(1) sentence 2 and 464(3) sentence 1 of the Code of Criminal Procedure (StPO), and that the trial court was entitled to defer the calculation of specific state expenses to the subsequent cost-ascertainment procedure under § 464b StPO without requiring a fractional distribution under § 464d StPO, as permitted by established legal doctrine.

Volltext
OLG Düsseldorf, JurBüro 1991, 853; Schmitt in Meyer-Goßner/Schmitt, StPO, 67. Aufl., § 472 Rn. 9; LR-StPO/Kurtze, 27. Aufl., § 473 Rn. 75).
BGH, Beschluss vom 27. Juli 2022 – 1 StR 145/22, NStZ-RR 2022, 391, 392; Schmitt in Meyer-Goßner/Schmitt, StPO, 67. Aufl., § 464d Rn. 1).
Die Kostenentscheidung im Beschwerdeverfahren folgt aus § 473 Abs. 1 Satz 1 StPO.
