The German Federal Court of Justice (BGH) dismissed the defendant's appeal, upholding the lower court's conviction and ordering the defendant to bear the costs of the appellate proceedings and necessary expenses for the auxiliary and adhesion plaintiffs. The case involved a criminal prosecution for sexual assault, where the defendant challenged the sufficiency of the evidence regarding the victim's incapacity to resist. The Court of Appeal had initially left ambiguous whether it applied the statutory provision for total inability to express will (§ 177 Abs. 2 Nr. 1 StGB) or significant impairment thereof (§ 177 Abs. 2 Nr. 2 StGB), with the BGH finding the evidentiary basis for these specific aggravating factors questionable. However, the BGH ruled that this ambiguity did not render the judgment legally flawed because the findings of fact clearly established that the victim consistently expressed a will contrary to the sexual act, and the defendant was aware of this, thereby satisfying the core elements of the basic offense under § 177 Abs. 1 StGB which was already cited in the indictment.

Main ground for dismissing the appeal as unfounded because the review did not reveal any legal error to the detriment of the defendant.
