Extradited defendant’s claim of specialty binding violation via informal deportation from third state
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice's Second Senate dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and ordering the defendant to bear the costs of the appeal. The dispute centered on a procedural challenge asserting that the transfer of the extradited defendant from Turkey to Germany violated the principle of specialty under international law, as the defendant claimed the deportation was arranged to bypass a formal extradition process with conditions. The court ruled that no such procedural bar existed because the transfer occurred on December 27, 2024, neither via mutual legal assistance nor under conditions set by the Turkish Republic, as required by Section 72 of the International Criminal Assistance Act (IRG). Consequently, the court held that whether the deportation complied with Turkish law was irrelevant to the specialty binding, and the alleged collusive action by German authorities to circumvent formal extradition was unsubstantiated.
