Narcotics import convictions: Rejection of revision for legally non-prejudicial discrepancies in formal conviction wording
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (BGH) rejected the defendant's appeal as unfounded, upholding the Landgericht Kleve's guilty verdict and ordering the defendant to bear the costs of the legal remedy. The case involved a criminal appeal challenging a conviction for multiple counts of importing narcotics in significant quantities, associated drug dealing, and driving without a license, where the appellate court reviewed the lower court's findings under the framework of prosecutorial procedural limitations. The decision rests on § 349 Abs. 2 StPO, finding no legal errors to the defendant's detriment; additionally, the Senate clarified that although the lower court's formal conviction wording did not fully align with the legal assessment derived from the established facts—including specific instances of joint offense and instigation under §§ 154, 154a StPO—this discrepancy did not constitute a disadvantage to the defendant.
