Criminal revision: validity of auxiliary participant’s late admission in appeal proceedings and mandate of legal advisor under § 397a StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Procedure dismissed the revision appeals of the defendants as unfounded, upholding the conviction from the Lower Regional Court of Bielefeld, while concurrently granting the victim’s mother the status of an auxiliary participant and appointing a mandatory legal advisor. The dispute centered on two procedural issues: the validity of the victim's mother's admission as an auxiliary participant after her initial filing failed to meet formal requirements, and the defendants' challenge to the first-instance judgment. The court held that an auxiliary participant's admission is permissible at any stage of the proceedings under § 395 Abs. 4 StPO, including during the revision stage, provided a valid declaration is submitted, and that the prior order to appoint an advisor was void because the applicant lacked auxiliary participant status at that time; the revision was rejected under § 349 Abs. 2 StPO as it revealed no legal errors to the defendants' detriment, with each defendant ordered to bear the costs of their appeal and the auxiliary participant's necessary expenses.

BGH, Beschluss vom 16. April 2024 – 6 StR 365/23 Rn. 4).
